Terms of Use for the “VDO Academy” Platform (Hereinafter Referred to as “Terms of Use”)

Section 1: General description of the VDO Academy platform

Thank you for choosing our VDO Academy platform, which is provided by Continental Automotive Technologies GmbH (hereinafter referred to as “Continental”). With the VDO Academy platform, you have the ability to book the available training courses at the training institutions authorized by Continental at any time, whether it is legally mandated training courses for authorized workshops under Section 57b German Road Traffic Act StVZO or advanced training courses.

Using various filters in the search function, such as postal code, training category, time period, type and training institution, you can find the training courses that are relevant for you. After successful registration, you can book one or more training courses at authorized training institutions. With the binding booking, a contract is established between you and the training institution selected by you. In this context, Continental acts only as a mediator between you and the training institution.

Once you have registered and logged on to VDO Academy, you will also have access to the following functions:

  • View of all training courses attended so far.
  • Reminder function for recurring training required by law.
  • Cancellation of an already-booked training course.

The authorized training institutions registered in VDO Academy offer the training courses defined by Continental and can decide for themselves the training locations, dates and prices for the offered courses. If no price is visible for a training course, this information can be requested directly from the respective training institution.

There is a contractual relationship between Continental and the authorized training institution according to which the authorized training institution is regularly audited by Continental with regard to course contents as well as the qualification of the instructors.

Section 2: Concluding contracts on the VDO Academy platform

With the binding booking, a contract is established between you and the training institution selected by you. In this context, Continental acts only as a mediator between you and the training institution.

The training institutions are obligated to publish their general terms and conditions of business on VDO Academy. You can download and view these at any time. To open PDF files, you need Adobe/Acrobat Reader (or similar).

Settlement of booked courses is performed by the training institution in accordance with their general terms and conditions of business.

Section 3: Use of the VDO Academy platform

Use of the free-of-charge VDO Academy platform is subject to the following:

  • You have created a user account (see Section 3 below).
  • You have agreed to the terms of use, which you have read carefully in advance.

You do not need a user account to carry out a simple search for a course. However, you will need to register to book the course with an authorized training institution.

When registering, you are obligated to ensure that all the information you provide is truthful and to inform Continental immediately if you make any subsequent changes to this information.

1. Registration
To register, you need to give: surname, name, birth name, date of birth, email address, language, company name (truck shop name) and address, user name and the desired password. If all the details are correct, you have to read and confirm the terms of use and Continental’s data protection provisions.

You also need to indicate whether or not you want to subscribe to the newsletter (you can, of course, cancel your subscription at any time).

Once you have entered and confirmed your details, the system checks whether your e-mail address is already registered.

Registration can now be completed. To do so, you will receive a confirmation e-mail with a confirmation link which you can click to complete the registration.

You can only book a course date after you have registered.

2. Security when using the VDO Academy platform
When you finish your session on the VDO Academy platform, you must always make sure that you log out. If you become aware that third parties are misusing your user details, inform Continental immediately in writing, if necessary with a simple e-mail to begin with.

Protect your user account by keeping your password confidential. You are responsible for all activities in and relating to your user account. If at all possible, do not also use your user account password for third-party offers.

You can request in writing the deletion of your registration at any time providing that this is not precluded by any transactions as part of ongoing contractual relationships or legal regulations. Continental will delete all user details and any other personal data relating to the user. Further information about how your personal data is handled when you use VDO Academy can be found in the footer "Data Protection".

3. Booking a course
In order to book a course, you must be logged on. If you have not yet registered, you must do that first.

After logging on, you can register for one or more trainings.

If you want to register for a legally required training course but have not yet been assigned to an truck shop known to the system, your information will be checked against that of the corresponding Continental truck shop with regard to truck shop membership to obtain any documentation that may be necessary (in case of an initial training course

Once you have registered for a course date, you and the respective training institution will receive an email confirmation as well as information concerning the registered course date. The number of free spaces is thereby automatically reduced in the system.

My trainings
In your user account, you can view all of the courses you have attended to date and download the respective training certificates (unsigned).

If you are unable to attend a booked training course, you can cancel it in your user account. The respective training institution and you will receive a confirmation email concerning your canceled training course.

If a course does not have the minimum number of participants or other unforeseeable reasons occur, the training institution may cancel a training course. In this case you will be notified by email and can select and register for an alternative course.

4. Do not misuse the VDO Academy platform
Do not use the VDO Academy platform in an improper manner. For example, you are not authorized to manipulate VDO Academy or access it in any way other than via the user interface provided by Continental and in accordance with our specifications.

VDO Academy is a platform for offering training courses that are conducted by authorized training institutions. The performance of the training courses is the sole responsibility of the respective training institution. Continental is not in any way responsible for them. Continental reserves the right to check content to ensure that it is lawful and/or complies with the relevant guidelines. We may remove content or refuse permission for it to appear on the portal if we can legitimately assume that it violates our guidelines and/or applicable law.

5. Intellectual Property
Notwithstanding the particular provisions in §3 use of the VDO Academy platform these Terms of Use, information, brand names and other contents of the VDO Academy website may not be changed, copied, reproduced, sold, rented, used, supple-mented, or otherwise used in any other way without the prior written permission of Continental Automotive Technologies GmbH. Also no multiplier training courses are allowed.

Section 4: Amending the terms of use

Continental may reasonably amend these terms of use or any additional conditions for VDO Academy (e.g. to take account of changes to general legal conditions or changes to our offering), so make sure that you check these terms of use regularly. We will tell you about any amendments to these terms of use on this page.

We will tell you about any amendments to additional conditions within the relevant service itself. Amendments do not apply retroactively; instead, they shall not apply until 14 days at the earliest following their announcement. However, amendments made in response to a new function for a service or for legal reasons are effective immediately. If you do not agree to the amended terms of use for a service, you will no longer be able to use this service.

Section 5: Liability

The information provided on the platform about any products and services made available can be changed or updated at any time by Continental without prior notice. The platform does not contain any guarantees or statements of quality for which Continental is liable, whether expressly or implicitly. Similarly, Continental makes no guarantee that the information provided is up-to-date, correct or complete and assumes no responsibility for its quality. The user shall not manipulate the platform and shall use it only as intended.

Claims by the user for compensation for damages that may arise in relation to the use of the platform and its content are excluded. This exclusion does not include claims for compensation of damages arising from injury to life, limb or health or the liability for other damages that are attributed to a willful or grossly negligent breach of a duty by Continental, its legal representatives or vicarious agents. In the event of a breach of material contractual obligations, Continental is only liable for the foreseeable and direct loss typical of this type of contract when this loss has been caused by simple negligence. Material contractual obligations are those that necessarily have to be fulfilled in order to achieve the object of a contract. These limitations of liability shall also apply to the benefit of the legal representatives and vicarious agents of Continental if claims are asserted directly against them. The regulations of the Produkthaftungsgesetz (German Product Liability Act) remain unaffected.

Section 6: Choice of law and place of jurisdiction

These terms of use are subject to the law of the Federal Republic of Germany under exclusion of the conflict of laws. The application of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (UN Sales Convention) is excluded.

For all disputes arising from or associated with these terms of use, the sole place of jurisdiction shall be Hanover, Germany.

Section 7: Online settlement of disputes

Information concerning the online settlement of disputes can be found at the following link on the website of the European Commission: http://ec.europa.eu/consumers/odr/. This link is provided for information purposes only in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council. Continental is neither willing nor obligated to participate in dispute settlement proceedings before a consumer arbitration board.

Section 8: Severability clause

Should individual provisions of these terms of use prove to be invalid in full or in part, then the validity of the rest of the contract shall not be affected by that. The statutory provisions shall replace the invalid provision.
