1 Scope of this data protection information

Continental Automotive Technologies GmbH processes your personal data during the use of the online training platform VDO Academy and the online partner management for the workshops commissioned according to § 57b StVZO and their competent specialists, in accordance with the applicable legal provisions

"Personal data" Article 4(1) General Data Protection Regulation (GDPR)

are any information relating to an identified or identifiable natural person. You are identifiable as a person if you can be identified directly (e.g. by your name or your recognisable face in an image recorded by a camera) or indirectly (e.g. by a pseudonym e-mail address).

"Processing" Article 4(2) GDPR

is any operation or set of operations performed in connection with personal data, whether or not by automatic means. These include, inter alia: collection, recording, reading, disclosure by transmission, reconciliation, restricting, erasure or destruction.

Controller Article 4(7) GDPR

"Controller" is a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

Processor Article 4(8) GDPR

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Recipient Article 4(9) GDPR

"Recipient" is a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data within the framework of a particular enquiry in accordance with Union or Member State law, shall not be deemed as recipients; this data shall be processed by those public authorities in accordance with the applicable data protection regulations according to the purposes of the processing.

Consent Article 4(11) GDPR

"Consent" of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3 General information

Personal data populated by you are processed by Continental Automotive Technologies GmbH for the purpose(s) specified below. If required by the purpose(s), a transfer of personal data to companies associated with Continental Automotive Technologies GmbH according to §§ 15 et seq. (German) Companies Act may occur according to the Binding Corporate Rules.

4 Processing of data

Processing your data occurs solely on the basis of the following data protection regulations (legal basis):

Your data will be processed for the duration of the commissioning for checking tachographs and control units, otherwise, they will be erased after 10 years, unless otherwise provided by legal retention requirements.
The data are stored for up to 10 years to be able to demonstrate that the requirements of § 57b(3)(2) StVZO for the commissioning of a motor vehicle repair workshop as an inspection body (legitimate interest) are met.

The TRAINING PARTNERS process your personal data under their own responsibility. If you enrol in a training course in the VDO Academy, we will transfer your personal data to the TRAINER PARTNERS for the maintenance and updating of all information relating to the commissioning according to § 57b StVZO within the training and partner management based on a legal requirement (Art. 6(1)(c) GDPR) and in all other cases based on the legitimate interests of the training partner (Art. 6(1)(f) GDPR). The legitimate interests of the training facility are in the use of the VDO Academy platform to increase efficiency when planning and organising training courses.

6 Rights of the data subject

Please note that you as the data subject have the following rights in relation to the processing of your personal data according to the EU General Data Protection Regulation (GDPR):

7 Protection of stored data

Our company uses technical and organisational safety measures to protect your personal data made available to us from manipulation, loss, destruction or access by unauthorised persons. The safety measures are continuously improved and adjusted according to the state of the art. Data provided without encryption may be accessed by third parties. Therefore, please note that a safe transfer of data via the internet (e.g. when communicating via unencrypted E-Mail) cannot be guaranteed. Therefore, sensitive data should either not be transferred at all or only via a secure connection (SSL). The SSL status of the connection can be determined based on the address line of your browser ("https").

8 Requirement of the provision of your personal data

You are neither legally nor contractually obliged to provide your personal data. However, use of the VDO Academy cannot occur without the provision of your personal data.
